German law sides with the tenant. The main tools: Mietpreisbremse — rent can only rise ~10% on new lets in tight markets; landlord termination only for cause (Eigenbedarf — but they must prove it!), deadlines 3–9 months by tenancy length; Nebenkosten — retroactive up to 12 months, verifiable; Mietmängel — something broken? Report in writing, allow a fair deadline, then reduce rent. The deposit is max 3 months’ rent, on a separate account.
- ●Check Eigenbedarf: "for myself" must be proven — otherwise the flat stays yours
- ●Mieterverein — a tenancy lawyer for ~€100/year: worth every cent
- ●Handover protocol on move-in/out — document everything, or no deposit back
🏠 ~55% of Germans rent — more than in any other rich country. Tenants’ associations protect ~1.5 million households — and win ~90% of disputes.
